I called the city attorney in regards to the wording in the ordinance, but since it's pretty close to Christmas, I haven't heard back. Based on the ordinance, it does not appear that these are discretionary incentives. Simply, if a business meets the requirements laid out, they get the incentives. I'm not sure it should be called automatic, since there is an application process and certain requirements have to be met.
This is also an early draft of the ordinance, so it could change between now and passage. From what I heard at the governing body meeting, there's no intent to deny companies would who rezone incentives. I'll let you know if I hear back from the city attorney.
